1. Acceptance of Terms

By accessing and using Humans ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms and Conditions, please do not use the Service.

2. Description of Service

Humans is a SaaS (Software as a Service) platform that provides social connection management tools for Instagram users. Our Service allows you to:

• Connect your Instagram account via Facebook's official API
• Import and sync your Instagram followers and followings
• Create custom fields and organize your connections into lists
• Search and manage your social network effectively
• Collaborate with team members on connection management

3. Account Registration and Security

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security of your password and accept all risks of unauthorized access to your account
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Instagram API and Facebook Login

Our Service uses Instagram's API through Facebook's authentication system. By using our Service, you also agree to:

• Facebook's Terms of Service
• Instagram's Terms of Use
• Meta's Platform Terms

You grant Humans permission to access your Instagram data as specified during the authentication process. We will only access data that you explicitly authorize.

5. Subscription and Billing

Humans offers subscription-based access to the Service, processed through Stripe, our payment processor.

5.1 Free Trial

We offer a 14-day free trial for new users. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

5.2 Subscription Plans

We offer the following plans:

• Starter: $9/month - 1 connection, 5 custom fields, 1 organization
• Pro: $29/month - Up to 5 connections, unlimited custom fields, 3 organizations, team collaboration
• Enterprise: $99/month - Unlimited connections, unlimited custom fields, unlimited organizations, advanced features

5.3 Payment and Renewal

• Subscriptions are billed monthly in advance and are automatically renewed
• All payments are processed securely through Stripe. We do not store your credit card information
• You authorize us to charge your payment method for the applicable subscription fees
• Prices are subject to change with 30 days advance notice
• All fees are non-refundable except as required by law

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to the Service until the end of your current billing period
• Your subscription will not automatically renew for the next billing period
• No refunds will be provided for partial months

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate Instagram's Terms of Service or Community Guidelines
• Engage in automated scraping or mass data collection beyond what the Service provides
• Send spam, unsolicited messages, or engage in harassment through Instagram
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service to harm, threaten, or harass another person
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute the Service without our express written permission

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Humans and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data you import into the Service. By using the Service, you grant us a license to use, store, and process your data solely for the purpose of providing the Service to you.

8. Data Retention and Deletion

Upon cancellation or termination of your account:

• Your data will be retained for 30 days in case you wish to reactivate your account
• After 30 days, all your data will be permanently deleted from our systems
• You may request immediate deletion of your data by contacting our support team
• Backups may be retained for up to 90 days for disaster recovery purposes

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy or completeness of any data obtained through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMANS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Humans, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also modify these Terms at any time by posting updated Terms on our website. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Humans is incorporated, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Humans regarding the Service and supersede all prior agreements and understandings.
